A 3PL warehouse in Poland: how a Turkish seller should choose one (returns, VAT, GPSR, shipping)

A 3PL warehouse in Poland is the invisible infrastructure behind selling on Allegro and Amazon (.pl/.de): the return address, delivery speed and return inspection all run through it. This article sets out the legal framework to know before choosing a warehouse (14-day withdrawal, two-year liability for non-conformity, the GPSR responsible person, packaging and BDO, the VAT consequence of stock) and gives the questions to ask a 3PL as a decision checklist.

The next question from a Turkish seller who has decided to sell on a marketplace is usually: "How do I choose a warehouse in Poland?" Choosing a 3PL warehouse in Poland (third-party logistics, an outsourced logistics service) is more than a price comparison: the warehouse becomes your return address, the team that keeps your consumer-law deadlines and, in some cases, your contact point under product safety rules. This article sets out the rules to know before choosing and the questions to ask a warehouse. The marketplace side is in the Allegro and Amazon (.pl/.de) articles.

Short answer: When choosing a 3PL warehouse in Poland, first settle four frameworks: holding stock in Poland triggers VAT registration; the warehouse address is your return address on marketplaces, and the deadlines of the consumer's 14-day withdrawal right and two-year non-conformity rights run through the warehouse; who is the responsible person in the EU under the GPSR must be in writing; and the business placing packaged products on the Polish market may need a BDO registration. Then ask the warehouse in writing about receiving, return inspection, integrations, invoicing, insurance and service levels.

Why a warehouse in Poland: return address and delivery

Shipping individually from Turkey is an option for testing, not for scale. Polish buyers expect fast delivery and easy returns, and marketplaces make these conditions. According to Allegro's Smart programme page for sellers, a seller who ships from Poland and offers delivery within Poland must provide a return address in Poland to join the programme. In practice, your Allegro return address is your warehouse address; return parcels arrive there and go back to stock or to the set-aside area.

How goods enter Poland (A.TR, import VAT, EORI) is in the article on shipping goods from Turkey to Poland. The warehouse starts where that import ends: receiving, counting and labelling.

What happens to VAT if stock is in Poland

The warehouse location is a tax decision. The short framework:

  • With a Polish company: Stock is in the Polish warehouse and sales are subject to Polish VAT; for shipments to consumers in other EU countries, once the EU-wide threshold is exceeded, the destination country's VAT is declared in Poland through OSS.
  • With your Turkish company: Holding stock in Poland requires Polish VAT registration, and a company established outside the EU can only register through a fiscal representative (VAT Act art. 18a).
  • If stock also moves to another country: Whichever country's warehouse the goods enter, VAT registration is needed there; the Amazon (.pl/.de) article explains this distinction model by model.

The invoices the warehouse issues to your Polish company are business-to-business invoices and go through KSeF, Poland's mandatory e-invoicing system; details in the KSeF article.

Return address in Poland and consumer law: which deadlines the warehouse keeps

Returns are the most underestimated topic in choosing a warehouse, because the law sets the deadlines and those deadlines run at the warehouse door. Under the Consumer Rights Act (ustawa o prawach konsumenta, consolidated text of 4 September 2026):

  • Withdrawal: 14 days. In a distance sale, the consumer can withdraw from the contract without giving reasons within 14 days of taking possession of the goods (art. 27–28).
  • Sending back: 14 days. The consumer sends the goods back within 14 days of the withdrawal statement; posting them before the deadline is enough (art. 34(1)).
  • Return shipping. The consumer bears only the direct cost of returning the goods; if the seller agreed to bear it or did not inform the consumer about it, the cost stays with the seller (art. 34(2)).
  • Refund: 14 days. The seller refunds all payments, including the original delivery cost, within 14 days of receiving the withdrawal statement; unless it offered to collect the goods itself, it may withhold the refund until the goods are received back or proof of dispatch is provided (art. 32).
  • Diminished value. The consumer is liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (art. 34(4)). To rely on this, returns must be inspected and photographed on arrival; that is the warehouse's job.
  • Non-conformity: two years. The seller is liable for a lack of conformity that existed at delivery and becomes apparent within two years (art. 43c). The costs of repair or replacement, including shipping, are borne by the seller, and the seller collects the goods from the consumer at its own cost (art. 43d).
  • Reply to a complaint: 14 days. If the seller does not reply to a consumer's complaint within 14 days, the complaint is deemed accepted (art. 7a).

These deadlines are why you ask the warehouse: "How quickly is a return processed, and when does the inspection report reach me?" If a return sits on a shelf for weeks, the refund and complaint deadlines run against you.

GPSR: who will be the responsible person

The General Product Safety Regulation (GPSR, EU 2023/988), applicable since 13 December 2024, requires an economic operator established in the EU to be responsible for a product sold in the EU, and in distance sales requires the listing to show the name, postal and electronic address of the manufacturer and, where relevant, of this responsible person (art. 16 and 19). Who can be responsible is listed in art. 4 of the Market Surveillance Regulation (EU) 2019/1020: a manufacturer established in the EU, an importer, an authorised representative with a written mandate, and, where none of these exists, the fulfilment service provider established in the EU handling the product. The Regulation defines this provider as a business offering at least two of warehousing, packaging, addressing and dispatching, without owning the products (art. 3).

This means a 3PL can be treated as responsible in your place; but we do not recommend building on that. When your Polish company is the importer, the responsibility already sits with it and the relationship with the warehouse stays clean. The question for the warehouse is: "In case of a product safety authority request or a recall, what information will you provide on my behalf, and how quickly?"

Packaging and BDO registration

According to biznes.gov.pl, businesses that introduce packaged products into Poland must register in the register of the BDO product and packaging database before starting that activity; the registration number is shown on invoices and other documents. The registration is made by the business placing the product on the market, not by the warehouse; but if the warehouse invoices you for filler and shipping packaging it uses, which return this packaging belongs in is clarified with the accountant. Selling to Germany also requires that country's packaging registration; details in the Amazon (.pl/.de) article.

Questions to ask a 3PL: a decision checklist

Ask the questions below in writing and get the answers in writing. A price quote only becomes comparable with these answers.

Receiving

  • How do you receive a full truck or groupage load from Turkey: by pallet or by carton, and is counting done per product?
  • Within how many days, and with what report, do you notify shortages, overages or damage?
  • If barcodes and Polish labels are missing, do you do the labelling?

Storage

  • Is the fee calculated per pallet, shelf or volume; is there a minimum?
  • Can you manage products that need expiry date or batch tracking?
  • How is liability shared for stock count discrepancies?

Picking and packing

  • Up to what time of day do orders ship the same day?
  • What packaging do you use; are branded packaging and invoice inserts possible?
  • Do you support the shipping methods the marketplace requires?

Returns

  • When a return parcel arrives, how quickly is it opened, inspected and photographed?
  • Within what time and in what format is the inspection result (back to stock, second grade, disposal, repair) reported to me?
  • For a non-conformity complaint, do you organise collection of the goods from the consumer?

Integrations

  • How are orders and stock synchronised with Allegro, Amazon (.pl/.de) and my own shop?
  • Do I have real-time access to stock and order data?

Invoicing and KSeF

  • Do you issue your invoices through KSeF, and are items (storage, outbound, returns) itemised?

Insurance and liability

  • Is stock in the warehouse insured against loss, damage and fire; what are the limit and the deductible?
  • How is liability calculated for wrong shipments and lost parcels?

Service levels and exit

  • Are there written targets (SLA) for dispatch time, error rate and return processing time; what happens if they are missed?
  • What is the notice period, and how and at what cost is my stock handed over on exit?

Frequently asked

Do I need a Polish company for a warehouse in Poland?

It is not a legal requirement, but when stock is held in Poland, Polish VAT registration is needed, and a Turkish company can only obtain it through a fiscal representative. The warehouse contract, return address, GPSR responsible person and invoices run more smoothly with a Polish company. That is why for regular sales we usually start with a Polish company; the decision comes from a product-level profitability check.

Can I use the warehouse address as my Allegro return address?

Yes, in practice the return address is the warehouse address. Allegro requires sellers who ship from Poland and offer delivery within Poland to provide a return address in Poland for the Smart programme. When agreeing with the warehouse, settle in writing in whose name return parcels are accepted, how quickly they are inspected and how the result is reported to you.

The marketplace's own warehouse or an independent 3PL?

If you sell on a single channel, the marketplace's own warehouse can simplify things; if you plan several channels, an independent warehouse is usually more flexible. A marketplace warehouse located in another country can trigger VAT registration there. The decision depends on product volume, return rate and number of channels; in the profitability check we calculate both options side by side.

How we run it

We map your product, channels and return expectations with you, assess warehouse options with the question list above and give you the comparison in writing. We explain the return, liability and exit clauses of the warehouse contract in Turkish, coordinate the first shipment and the return flow, and act as your Turkish-speaking contact with the warehouse in daily operations. The warehouse is operated by a licensed logistics partner; VAT, OSS and BDO matters sit with our certified accountant partner, and the legal review of the contract with our lawyer partner.
